• Secured a unanimous jury defense verdict on behalf of law enforcement client. Air ambulance operator claim that one of its parked aircraft sustained damage when law enforcement helicopter negligently overflew it.
• Prevailed on a motion for summary judgment for airline client in a high-stakes wrongful death case in federal court arising from alleged damage to a power wheelchair in transportation.
• Prevailed on a motion for summary judgment in a premises liability lawsuit in California state court, arising from alleged TBI and other serious injuries allegedly sustained in a baggage claims area, after proving that the instrumentality of the injury was not under the client’s control.
• Obtained dismissal of claims arising out of Covid restrictions on behalf of medical services provider in litigation in California and New York.
  Negotiated substantial pre-litigation settlement for a claimant client in a breach of contract dispute between two R&D and manufacturing companies.
• Expediently resolved two serious personal injury lawsuits arising from alleged passenger slip and falls in the check in area, and in the jet bridge, by settlement with no contribution by airline client, after causing ground handling agent to accept tender despite pushback.
• Obtained early voluntary dismissal of airline client from a personal injury lawsuit after initial investigation undermined Plaintiff’s allegations that the airport area where the injury occurred was under the client’s responsibility.
• Obtained dismissal of action asserting civil rights claims, intentional infliction of emotional distress, and violation of Air Carrier Access Act on behalf of major air carrier.
• Obtained favorable defense costs settlement for airline client in a wrongful death matter arising from airport tug accident after discovery and investigation undermined Plaintiff’s liability theory.

2023

• Obtained a complete defense jury verdict against high-profile plaintiffs’ attorneys in a racial discrimination case filed by a passenger against airline client.
• Prevailed on a motion to dismiss in federal court pursuant to a statute of limitations in favor of airline client in a wrongful death lawsuit allegedly arising from an incident involving wheelchair assistance.
• Prevailed on a motion to dismiss in favor of airline client on the grounds of federal preemption, in a lawsuit allegedly arising from disability discrimination against a passenger.
• Prevailed on improper venue motion in Pennsylvania Superior Court in Philadelphia County was improper where our client had insufficient quality and quantity of contacts and the cause of action did not arise out of any activities in Philadelphia County. Venue found more appropriate in an outlying more favorable county.
• Prevailed on three successive motions to dismiss, each followed by an amended complaint, for an airline client which was sued for race discrimination after plaintiff was forcibly removed from a flight by airport police. Plaintiff claimed a severe allergy to dogs could kill her but refused to disembark when asked. The case then proceeded on two tracks, one in the district court where plaintiff sought a trial on a third amended complaint and in the Fourth Circuit for the dismissal. The district court denied post-judgment relief and plaintiff noted a second appeal. The United States Court of Appeals affirmed, while correcting the standard for granting leave to amend on a Rule 60 motion for relief from a judgment.
• Negotiated a favorable outcome for an outside general counsel/transactional client, with no money paid by client in a dispute relating to termination of an executive.
• Prevailed on a motion to dismiss of lawsuit allegedly arising from an improper denied boarding of a passenger.

Previous Victories

• Successfully defended appeal from grant of summary judgment in favor of airline client in a personal injury lawsuit by passenger allegedly arising from a turbulence event pursuant to the doctrine of Federal Aviation Act preemption in the Ninth Circuit Court of Appeal.
• Obtained summary judgment on behalf of airline service provider in claim alleging serious injuries arising out of client’s alleged negligence.
• Obtained nearly 8-figure arbitration award for charter airline in ICC arbitration against major international organization over commercial dispute.
• Obtained a voluntary dismissal of airline client –with no money paid in settlement— from a personal injury and premises liability lawsuit after investigation and discovery refuted plaintiff’s claims against the client.
• Prevailed on a motion to dismiss for lack of personal jurisdiction on behalf of a government entity client in an alleged fraud and conspiracy lawsuit in state court.
• Obtained a dismissal with prejudice of all claims against an airline client in a personal injury case arising from an alleged hard landing after successful tender and settlement between the parties with no contribution by airline client.
• Negotiated withdrawal of subpoena for extensive business records directed to company client in connection with a personal injury lawsuit.
